Employment and Labour
Overview
Our employment and labour law practice is an integral part of our full-service offering, providing pragmatic, business-aligned advice across the full spectrum of labour and employment-related matters. We advise both Indian and international clients, including corporates, startups, funds, boards and senior management, on structuring employment relationships, addressing compliance obligations and navigating contentious employment scenarios with discretion and legal rigor.
Expertise
We regularly advise on employment contracts, consultancy and advisory agreements, non-compete and confidentiality obligations, workplace policies (POSH, disciplinary, grievance, hybrid/remote working, whistleblower, data privacy, etc.) and employee manual & handbooks. Our lawyers are deeply experienced in guiding companies through workforce restructuring, layoffs, terminations and internal investigations while mitigating risk and maintaining compliance with Indian labour laws and evolving jurisprudence.
We also assist with designing and implementing employee stock option plans (ESOPs), phantom equity and other incentive structures that align with both domestic and global best practices and regulatory requirements. As part of our end-to-end support, we routinely advise on provident fund, gratuity and other statutory contributions, as well as manage interactions with labour authorities.
Our team regularly supports clients in employment law audits, cross-border secondment arrangements, intra-group transfers, senior-level employment exits and employment aspects of M&A transactions. We also have deep experience in dealing with theft of intellectual property and other proprietary interests, including by drafting and negotiating strategies to mitigate risk, and even recovery through formal and informal dispute resolution mechanisms. We have also advised on complex matters involving privacy and data security issues involving employees, and have guided several international clients in navigating local laws by providing practical advice. With an increasing focus on workplace governance and compliance, we partner with clients to ensure policies and practices reflect current regulatory expectations while also supporting company culture.
We represent both employers and employees before labour courts, tribunals and relevant authorities in employment-related disputes, and work closely with our dispute resolution team on sensitive employment litigation. Our employment practice seamlessly complements our corporate, M&A and compliance teams, enabling us to provide holistic and strategic advice that serves both legal and business objectives.
